These Terms of Service (the “Terms”) are a binding agreement between you and Private Pocket AI (“Private Pocket AI”, “we”, “us”) governing your use of privatepocketai.com and your purchase of our products. Please read them carefully. By accessing the website, placing an order or using our materials you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. If you buy on behalf of a business, you confirm that you have authority to bind it.

2. Our products

Pocket Launch Program. A one-time purchase of digital training and tools, comprising video lessons, the Pocket Installer, the Pocket Prompt Library, the Persona Pack, the Signal Bridge and Concierge Setup Support (together, the “Program”). You receive lifetime access to the version you purchase and to updates we choose to release for it, for as long as we operate the Program.

Pocket Circle. An optional monthly membership that may include new skills, model upgrades, live Q&A, community access and priority support (“Pocket Circle”). Features may change over time.

Descriptions, screenshots and demonstrations are illustrative. Actual AI output, speed and quality vary with your server, the model you choose and your inputs.

3. Orders, prices and payment

Prices are shown in US dollars and may be changed at any time; changes do not affect completed orders. You authorise us and our payment provider to charge your chosen payment method. Taxes (such as VAT or sales tax) are added where required. You are responsible for accurate payment details. We may refuse or cancel orders in cases of suspected fraud, abuse or pricing error.

4. Subscriptions and cancellation

Pocket Circle includes a free first month and then renews automatically each month at $19 until you cancel. You may cancel at any time as described in our Refund Policy; cancellation takes effect at the end of the current billing period. We will give at least 30 days’ notice of any price increase to existing members, who may cancel before it applies.

5. Third-party hosting and software

To use the Program you must obtain your own hosting account and server from a third-party provider, at your own cost. We are not affiliated with, and do not control or warrant, any hosting provider. The AI models and other software used by the Program are generally open source and are licensed to you by their respective owners under their own licences, which you must comply with. Nothing in these Terms transfers ownership of third-party software to you or us.

6. Licence to our materials

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Program for yourself, and for your own internal business purposes. You may not copy, resell, redistribute, publish, share login or access details, or use our materials to create a competing product or course. All intellectual property in the Program, the Pocket Installer, our branding and website content is owned by us or our licensors and is reserved.

7. Your content and your AI

You own the data you put into, and the output produced by, your private AI assistant on your own server. We have no access to it and no licence over it. You are solely responsible for how you configure and use your assistant, for the content you process, and for complying with all laws that apply to you (including data-protection, privacy and consumer laws).

8. Acceptable use

You agree not to use the Services or anything you build with them to: break any law or infringe others’ rights; generate or distribute unlawful, harmful, harassing, deceptive or malicious content; attempt to gain unauthorised access to any system; introduce malware; interfere with the Services; or misrepresent your affiliation with us. We may suspend or end access without refund where you materially breach these Terms.

9. AI output; no professional advice

AI assistants can produce inaccurate, incomplete or outdated output. Output is provided for general information only and is not legal, medical, financial, tax or other professional advice. You must independently verify important information and should consult a qualified professional before relying on it. You use AI output at your own risk.

10. Support

Support is provided by email to support@privatepocketai.com on a reasonable-efforts basis, typically within one business day. Support covers the Program as described; it does not cover third-party services or your own customisations.

11. Refunds

Our 30-day money-back guarantee and other refund rules are in the Refund Policy, which forms part of these Terms.

12. Disclaimers

To the fullest extent permitted by law, the Services and all materials are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability and uninterrupted or error-free operation. We do not guarantee any particular result, performance level or outcome. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded under mandatory consumer law.

13. Limitation of liability

To the fullest extent permitted by law: (a) we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Services; and (b) our total aggregate liability for all claims will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be limited by law.

14. Indemnification

You agree to defend, indemnify and hold harmless Private Pocket AI, its owners, officers, employees and contractors from claims, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your content or use of your AI assistant in violation of law or third-party rights. This section does not apply to consumers where prohibited by law.

15. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services (in which case we will refund any prepaid, unused membership fees). Sections that by their nature should survive termination will survive, including licence restrictions, disclaimers, limitation of liability and governing law.

16. Governing law and disputes

These Terms and any dispute arising from them are governed by the laws of the jurisdiction in which Private Pocket AI is established, without regard to conflict-of-law rules. Before starting formal proceedings, you agree to contact us at support@privatepocketai.com and give us 30 days to resolve the dispute in good faith. Subject to that, the courts of the competent courts of the jurisdiction in which Private Pocket AI is established have exclusive jurisdiction, except that where mandatory consumer law gives you the right to bring proceedings in your home courts or to rely on your home country’s consumer protections, nothing here removes that right.

17. General

Entire agreement: these Terms, the Privacy Policy and the Refund Policy are the whole agreement between us on this subject. Changes: we may update these Terms; the updated version applies from the date posted, and continued use constitutes acceptance. For material changes affecting existing customers we will give notice. Severability: if any provision is held unenforceable, the rest remains in force. No waiver: failure to enforce a provision is not a waiver. Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger or sale of the business. Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control. Notices: we may notify you by email or by posting on the website.
